Terms of Service

1. Agreement to Terms

By accessing or using MIA AI (“the Service”), operated by MIA AI Holdings Inc., you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

MIA AI Holdings Inc. reserves the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms.

2. Description of Service

MIA AI is an emotional AI companion that provides:

• Text-based conversational AI with memory and emotion capabilities
• Voice chat functionality using MIA-Voice synthesis technology
• Integration with X for social interactions via @miaaibot
• Personal and shared memory systems
• Multi-language support (English/Japanese)

3. User Accounts

To access certain features, you must create an account using X OAuth authentication. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Providing accurate and current information
• Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive behavior.

4. Acceptable Use

You agree NOT to use the Service to:

• Harass, abuse, or harm others or attempt to manipulate MIA's emotional systems maliciously
• Transmit malicious code, viruses, or attempt prompt injection attacks
• Attempt to bypass rate limits or security measures
• Impersonate others or misrepresent your affiliation
• Generate content that is illegal, harmful, or violates third-party rights
• Use the Service for commercial purposes without authorization
• Attempt to reverse engineer, decompile, or extract our AI models
• Spam, flood, or abuse the X bot integration

5. Intellectual Property

The Service, including its design, features, MIA's personality, and underlying technology, is owned by MIA AI Holdings Inc. and protected by intellectual property laws.

You retain ownership of content you submit, but grant us a license to use it for providing and improving the Service. This includes storing memories and using anonymized data for training purposes.

6. AI-Generated Content

MIA AI generates responses using artificial intelligence. You acknowledge that:

• AI responses may not always be accurate, appropriate, or reflect real-world facts
• MIA's “emotions” are simulated and part of the entertainment experience
• The Service should not be used as a substitute for professional advice (medical, legal, financial, etc.)
• You are responsible for your decisions based on AI-generated content

7. Third-Party Services

The Service integrates with third-party providers including:

• xAI: Powers MIA's conversational AI and reasoning capabilities
• X: Authentication and social integration via @miaaibot
• Solana: $MIA token and blockchain interactions

Your use of these integrations is also subject to their respective terms of service.

8. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. MIA AI HOLDINGS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid for the Service in the past 12 months, or $100 USD, whichever is greater.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any violation of these Terms. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by contacting us. Certain provisions of these Terms shall survive termination.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
